James Monroe Middle School Discipline Policy

The following is a summary of our school discipline plan.   Students should remember to keep their hands to themselves and to not touch or bother possessions of other students.   Most discipline problems result from students not following these two rules of conduct.   Please be aware that students are responsible for following all school rules and regulations while at school, at any school activity, and while going to and from school.

INFRACTIONS

Bullying, Threatening, and Harassing – Any physical, spoken, or written act of abuse, violence, harassment, intimidation, extortion, the use of vulgarity, cursing, making remarks of a personally destructive nature toward any person, and any restriction or prevention of free movement of an individual is a violation of school rules.   This prohibition applies whether the act is deliberate, intentional or unintentional or is directed toward an individual or group regarding race, color, creed, national origin, sex, sexual orientation, physical or mental disability, political or religious ideology.

Assault against a person – Unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another.

Assault with a deadly weapon – Any person who commits an assault with a deadly weapon.

Battery – Any willful and unlawful use of force or violence upon a person.
Possession of look-alike weapons or any dangerous object.

Fighting – Mutual combat in which both parties have contributed to the situation by verbal and/or physical action.

Sexual Harassment – Unwelcome sexual advances, requests for sexual favors, and other verbal, visual acts made by any employee, volunteer, or student in the school district.

Possession of fireworks, smoke bombs, poppers, and/or stink bombs.

Possession or use of any of the following: drug paraphernalia, drugs, unauthorized controlled substance, and/or alcohol.

CONSEQUENCE
Conference with student and parent; suspension for one (1) to five (5) days; possible recommendation for expulsion; possible referral to Ridgecrest Police Department depending on the severity of the student's behavior and the frequency of such behavior.

 

INFRACTIONS

Weapon possession
Possession of a firearm of any kind or brandishing of a knife

Sexual assault or battery – Unwelcome sexual advances, requests for sexual favors, and other verbal visual or physical conduct of a sexual nature made by any employee, volunteer, or student in the school district.

Selling drugs or any unauthorized substances

CONSEQUENCE
Five (5) day suspension; mandatory recommendation for expulsion; referral to Ridgecrest Police Department

Canine Search – Our school cooperates with the Canine Search and Training program of the Ridgecrest Police Department to help ensure that our campuses remain safe and drug-free.

 

INFRACTIONS

Chronic willful disobedience, defiance of authority, disruptive behavior.

Making, possessing, or selling false identification; forgery.

Acts that interfere with the private lives of school employees.

Gambling, vulgarity, profanity

Being in a group where tobacco, alcohol, or any other discovered illegal substance is evident or in possession.

Gang associations for the purpose of intentionally harassing, threatening or intimidating a student or group of students.

Knowledge of a weapon, dangerous object and/or dangerous situation without notifying school authorities.

Academic dishonesty, cheating, changing grades, plagiarism, etc.

Detention violation

Failure to complete consequence issued.

Leaving campus without permission of school.

Misbehavior on school bus.

Continual improper dress for school and related functions (Dress Code Violations).

Students with no assigned class or activity may not be on campus during the school day.

CONSEQUENCE

Conference with student and/or parent and/or one (1) to five (5) days suspension depending on the severity of the student's behavior and the frequency of such behavior.

 

INFRACTIONS

Vandalism, theft, destruction, or defacement of school property (graffiti of any kind).

Interference/Obstruction – Any action taken to attempt to prevent a staff member from exercising lawful assigned duties.

CONSEQUENCE

Conference with student and/or parent; one (1) to five (5) days suspension and/or restitution for defaced or destroyed property depending on the severity of the student's behavior and the frequency of such behavior

 

Education Code 48915 was amended, effective January 1, 1994 to state (in part):

Possession on their person, or in a backpack or purse, of any knife, explosive, or other dangerous object of no reasonable use to the pupil at school or at a school activity off school grounds shall be grounds for immediate suspension and recommended expulsion.   This includes any type of fireworks, caps, bullets, or knives of any size or type or any sharp objects such as exacto-knives, all-purpose openers or any look-alike weapons, including water pistols or cap guns.   In addition, the principal shall immediately suspend and recommend expulsion, for any student in possession of a firearm, real or otherwise.

Fundraisers :   Only items promoted by James Monroe Middle School fundraisers may be sold on campus.   Other items being sold for profit will be confiscated and suspension may ensue.
